Last week, a federal appeals court found the Federal Housing Finance Agency (FHFA), the conservator of Fannie Mae and Freddie Mac, unconstitutional in its single-director structure. The court made this ruling for 2 primary reasons: 1) It does not answer directly to the president, and 2) it doesn’t receive funding from Congress or feature a bipartisan commission, which means the director, who can't be fired by a sitting president without cause, effectively insulated from executive oversight.
